Bus Lane Fine Appeal UK — The Grounds That Actually Win

Around 40% of bus lane PCNs that are formally challenged are cancelled or overturned. The Traffic Management Act 2004 and TSRGD 2016 impose strict requirements on councils — and many PCNs fail to meet them.

Camera Approval Requirements

Bus lane cameras must be approved under the Civil Enforcement of Road Traffic Contraventions (Approved Devices) Order 2022. Request a copy of the approval certificate for the specific camera and date of your alleged contravention. If the council cannot produce this, or if the device was not approved at the relevant time, challenge the PCN on this ground alone.

Signage Compliance — TSRGD 2016

Bus lane signs must comply with the Traffic Signs Regulations and General Directions 2016. The sign must be the prescribed design (diagram 959.1 or equivalent), positioned correctly, clearly visible, and match the terms of the Traffic Regulation Order. Faded signs, obscured signs, or signs positioned after a junction entry point are all challengeable.

Request photographs of all signage at the approach to the bus lane, the TRO itself, and the CCTV still images. Compare the sign times against the alleged contravention time carefully.

Operating Hours Discrepancy

Most bus lanes only operate during peak hours (e.g. 07:00–10:00 and 16:00–19:00 Monday to Friday). If your alleged contravention falls outside those hours, the PCN is invalid. The times stated on the sign and in the TRO must match exactly. Any discrepancy between the sign and the TRO can also void the PCN.

Permitted Turns and Exemptions

TROs commonly exempt vehicles making a permitted turn at a junction from the bus lane restriction. If you entered the bus lane to turn, obtain the TRO and check for this exemption. It is a complete defence if it applies. You can request TROs via the council's website or a Freedom of Information request.

The Appeal Process Under TMA 2004

Once you receive a bus lane PCN, you have 28 days to make an informal challenge (or 14 days for the discounted rate). If rejected, you make formal representations. If those fail, you can appeal to the Traffic Penalty Tribunal — an independent body whose decisions are binding on councils. Around 55% of cases that reach the TPT result in cancellation.

Frequently Asked Questions

Do bus lane cameras need to be officially approved?

Yes. Cameras used to enforce bus lane contraventions must be approved under the Civil Enforcement of Road Traffic Contraventions (Approved Devices) Order 2022. You can request evidence of camera approval from the issuing authority. If they cannot produce it, the PCN is challengeable.

What if I entered the bus lane to make a turn?

Many Traffic Regulation Orders (TROs) for bus lanes include exemptions for vehicles making permitted turns at junctions. If you entered the bus lane to turn, check the TRO for your specific location. The TRO can be obtained from the council or via a Freedom of Information request. If the TRO permits the turn, the contravention did not occur.

Can I appeal if I entered the bus lane to avoid an obstruction?

Yes. Entering a bus lane to avoid a stationary vehicle, road works, or debris is a recognised mitigation and sometimes an absolute defence. Dashcam footage significantly strengthens this. Even a consistent written account, if detailed and credible, can succeed at the Traffic Penalty Tribunal.
